What is a Humanitarian & Compassionate (H&C) application?

A Humanitarian and Compassionate application allows individuals who do not qualify under standard immigration programs to request permanent residence based on exceptional circumstances.

H&C applications are discretionary and assessed on a case-by-case basis. Approval is not guaranteed, and there is no fixed checklist for success. Officers evaluate whether the totality of the circumstances justifies granting permanent residence despite non-compliance with immigration rules.

Who H&C applications are generally appropriate for

H&C applications are typically considered when no other immigration pathway is available and removal from Canada would result in disproportionate hardship.

Factors considered by IRCC

  • • Hardship upon return to the country of origin

Understanding hardship

Hardship must be greater than what is normally expected when a person is required to leave Canada. General inconvenience, economic disadvantage, or preference to remain in Canada is usually insufficient.
